Welcome to BxCircle. These Terms of Service ("Terms") govern your access to and use of the BxCircle platform (the "Platform"), including all related services, features, and content. Please read these Terms carefully before using the Platform.
1. Acceptance of Terms
By accessing or using BxCircle, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
2. Eligibility
BxCircle is designed for professionals working in or studying Applied Behavior Analysis. You must be at least 18 years old to create an account. By registering, you represent and warrant that: (a) you are of legal age in your jurisdiction; (b) the information you provide is accurate, current, and complete; (c) you will maintain and promptly update your information; and (d) your use of the Platform does not violate any applicable law or regulation.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: (a) notify BxCircle immediately of any unauthorized use; (b) not share your account with others; and (c) not create multiple accounts. Credential badges (RBT, BCaBA, BCBA, BCBA-D) displayed on your profile reflect self-reported or verified information and do not constitute endorsement by BxCircle or any credentialing body.
4. Confidentiality & Protected Health Information
Users must protect client confidentiality at all times.
You agree that you will NOT share any protected health information (PHI), client-identifying details, or case-specific information that could identify individuals receiving behavioral services. This includes but is not limited to: names, locations, physical descriptions, photographs, dates of service, diagnosis information, treatment details, or any combination of details that could reasonably identify a client.
Violations of this policy will result in immediate content removal and may result in account suspension or permanent termination. Repeat violations will result in permanent ban from the Platform.
5. Content Guidelines
Users are responsible for all content they post on the Platform. By posting content, you represent that you have the right to share it and that it complies with these Terms and our Community Guidelines.
BxCircle reserves the right to remove any content that: violates these Terms; is deemed inappropriate, harmful, or misleading; could compromise client confidentiality; infringes on intellectual property rights; or is reported by users and confirmed as violating our policies. The Platform does not provide client-specific treatment advice and should not be used as a substitute for professional clinical judgment.
6. No Official Affiliation
BxCircle is an independent professional community platform. We are NOT affiliated with, endorsed by, or officially connected to the Behavior Analyst Certification Board (BACB), the Association for Behavior Analysis International (ABAI), or any other credentialing, licensing, or professional organization. References to certifications, credentials, or professional designations are for informational and community purposes only.
7. Intellectual Property
Your content: Content you post on BxCircle remains your intellectual property. By posting, you grant BxCircle a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Platform. This license ends when you delete your content or account, except for copies that have been shared by other users.
Platform content: The BxCircle name, logo, design, and proprietary features are owned by BxCircle and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Platform without written permission.
8. Prohibited Conduct
You agree not to:
- Share client-identifying information or protected health information
- Impersonate other professionals or misrepresent your credentials
- Harass, bully, threaten, or discriminate against other users
- Post spam, unsolicited advertisements, or commercial solicitations
- Attempt to access other users' accounts or private data
- Use automated tools (bots, scrapers) to access the Platform without permission
- Upload malware, viruses, or other harmful code
- Circumvent security measures or access restrictions
- Use the Platform for any unlawful purpose
- Interfere with the Platform's operation or other users' experience
9. Job Board & Applications
BxCircle provides a job board as a convenience to users. We do not guarantee the accuracy of job listings, the legitimacy of employers, or the outcome of any application. Employers are responsible for the content of their listings and compliance with employment laws. BxCircle is not a party to any employment agreement between users and employers. Salary information displayed on the Platform is user-reported and may not reflect actual compensation.
10. Subscriptions & Payments
BxCircle is currently free to use. If we introduce paid features or subscriptions in the future, we will provide clear pricing information and obtain your consent before charging. Any paid features will be subject to additional terms that will be presented at the time of purchase.
11. Termination
BxCircle reserves the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, Community Guidelines, or for any other reason at our sole discretion. You may delete your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will survive.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ABA CIRCLE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE, VERIFY, OR GUARANTEE THE ACCURACY OF ANY USER-GENERATED CONTENT, CREDENTIALS, OR PROFESSIONAL CLAIMS MADE ON THE PLATFORM.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABA CIRCLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ABA CIRCLE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify, defend, and hold harmless BxCircle and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you post on the Platform.
15. Dispute Resolution
Informal Resolution: Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the state of Delaware, unless you and BxCircle agree otherwise.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the federal or state courts located in Delaware.
17. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the Platform or via email at least 30 days before taking effect. Your continued use of BxCircle after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and delete your account.
